Law is common to all. Knowledge about Medico legal is-sues is not optional for a treating Doctor but a mandatory social re-sponsibility. Proper knowledge of the roles and responsibilities of a health care provider is of im-mense importance while han-dling these cases to facilitate so-cial and legal justice. A health care provider along with the medical records called to the court as an expert witness is of pivotal importance for the pro-ceedings of the trial and any in-competence by the health care provider can result in grave con-sequences for both the Institution and self.The health care provider must therefore exercise vigilance and proper documentation while treating a Medico Legal Case. It is advisable to follow the legal as-pects to avoid embarrassment in the court of law due to the lack of knowledge or awareness regard-ing MLC’s and their practices.Hence, this effort is done to compile a set of basic guidelines to be practiced in a hospital when dealing with MLCs. The follow-ing is a non-exhaustive list of guidelines compiled to effectively handle MLCs in a hospital.Role of Doctor in CasualtyRemain calm, do not panic, and treat as a regular case.Lives saving measures are always FIRST in priority.MLC workup is done SOON after it.Casualty services are 24×7 CMOs are supposed to reg-ister MLC by entering the follow-ing in the MLC register. Preliminary data:Name –Full name should be taken with ini-tials,Age Sex Address –local and permanent. Identification marks:Two reliable identifi-cation marks have to be noted preferably from the peripheral parts of the body,If not found then it could be from private parts Mole/scar/birth mark/ deformity/ any other peculiar mark can becon-sidered. Consent of the patient / relative has to be taken:Signature/ thumb impression of the patient.Signature of the rela-tive / guardian. Brief history of the inci-dent –time/ place/nature of in-cident. Examination findings:Injuries must be noted in the order of Head to toe or major to minor injuries.

Treatment given:Immediate treat-ment givenReferral to the concerned department. If referred outside –Place where it is referred should be mentioned. Information given to police –Name of the Police Station.Deciding a case as Medico-Legal or not, is based solely on the treating DoctorMLC can be registered at any time after the patient has come to the hospital –arrival/ later –based on the time of suspi-cionAny Doctor at any point of their treatment should inform the CMO regarding any suspicion about any foul play suggestive of unnatural means in the case.It is better to register as MLC and later easy to convert into non MLC than vice versa if the Doctor is in dilemma about the case.Once MLC done –either in our hospital or outside is suffi-cient –no need to repeat the same.

Avoid guessing, assumptions about the facts. All the information written should be legible, understandable and simple in nature. I think we can all agree, this Month’s banner says it all!  No one wants to deal with it but we all need to be aware!  Breast cancer is the number one cancer that causes death in women.  Men are not completely exempt from developing breast cancer .  Although less than 1% of all breast cancer cases develop in men, that is enough to consider a risk.  What’s more, the mortality rate for men diagnosed with breast cancer is much higher than in women.  Research indicates that lifestyle and reproductive factors play a huge part in risk factors.  In fact there is a lower incidence of breast cancer among women in less developed countries.  

Risk factors to consider:

Being a woman – simply, women are at higher risk for breast cancer

Age – Women over 50 are at a higher risk for developing breast cancer

Family History – Higher incidence of breast cancer in your genes will increase your own risk

Ethnicity – White women have a slightly higher risk for developing breast cancer

Weight – overweight women tend to be at a higher risk for breast cancer

Pregnancy/breast feeding – Women who have had children or breast fed, are at higher risk

August is National Immunization Awareness Month

Second opinions save lives. The case of a dangerous huckster makes that clear.

An oncologist from Michigan was given a 45 year prison sentence for pulling in over 17 million in fraudulent billings for patients he mistreated and misdiagnosed.

The court found Farid Fata had prescribed unnecessary injections and given potent chemotherapy infusions to over 550 patients within a six-year period.  Many of the patients didn’t even have cancer.

Many were grievously injured and had their immune systems permanently damaged.  One man lost both of legs, and died soon after.

Fata kept some patients drugged up for years at a time, bankrupting families having to pay for the medical bills.  He insisted that if they stopped treatment, they would die.  He would also stop receiving their insurance payments.

With all this said, most of Fata’s patients still trusted him.  He was one of the most prestigious oncologists in Michigan.  He received a lot of referrals from other doctors as well.

He was so powerful and admired, few dared to question his practices.

And so he continued for years.

Fata’s story began to unravel when one patient broke her leg.  It was determined this patient didn’t have cancer upon closer examination of her records and she was advised to get a second opinion.

Fata’s story is one in a million.  One attorney called his crimes “the most egregious case of medical fraud in the history of the United States.”

This story stresses the importance of getting a second opinion.

When facing important medical decisions, being well informed is vital as it can potentially have a huge impact on a patients life.  The Patient Advocate Foundation says many physicians would recommend getting one and patients shouldn’t feel they are being unfaithful to their doctor.

Ethical doctors understand that patients have a right to be well informed about their conditions in order to make decisions about their care.  Doctors who don’t welcome second opinions — such as Fata, who openly discouraged them — should be avoided.
